Escape Today Pty Ltd ABN 42 271 885 337 (Escape Today) operates and administers www.find4me.com.au (Website).  By using or viewing the Website you agree to be bound by the following terms and conditions of use (Conditions of Use):

When you make a booking with us the following terms and conditions will apply:

  1. Age: You must be at least 18 years of age to make a booking of any services displayed on our site.
  2. Payment: You must make payment for the services booked on the site at the time of booking and you agree to make payment via a debit to your nominated credit card or bank account. The amount debited will (subject to the following) be the amount shown on our booking page prior to you clicking the "Pay Now" button on that page. Depending upon the currency of the booking, your credit card or bank account's currency and the country in which your card was issued, your credit card or bank account provider may impose foreign exchange fees and other fees which are in accordance with your arrangements with that credit card or bank account provider. 
  3. Changes to Bookings: If you want to change any details of your booking, you must contact the supplier of the services directly – refer to your tax invoice for full details. Our suppliers will do their best to assist you, but cannot guarantee that changes can be made. Please note that:
  • bookings at certain service providers, or in certain time periods, or for certain service types cannot be cancelled or changed; and
  • some service providers may permit cancellations or changes but this may involve that service provider imposing a charge,
  • and this information will be displayed (see cancellation policy) on the relevant service provider details page, which you access prior to making a booking.
  • All booking changes and permitted cancellations will not be refunded the service fee paid at booking. This represents an administrative charge for processing of booking changes and permitted cancellations on our websites.
  • If you fail to cancel a booking, our supplier may charge you for up to the full amount of the service which has been agreed to when the booking was made, in accordance with their cancellation policy.
  1. Requirements upon service: We do not provide your credit card or bank account details to any service provider and as such you will be required to pay the balance for your services at the time of the appointment. In addition, to eliminate identity fraud, the service provider may ask you to provide photo ID to ensure that your identity matches the booking identity. 
  2. Site Information: We make every effort to ensure all information displayed on our site is accurate; however, as considerable information is accessed from our service partners, we are unable to guarantee the accuracy of all information nor are we able to guarantee that the site is free of errors or faults. We reserve the right to change information displayed on our site (including these terms and conditions) at any time without notice to you. 
  3. Liability: Without affecting any of your statutory rights that cannot be lawfully excluded, we will not be liable for any losses, damages, liability, claims or expenses (whatsoever and irrespective of whether direct, indirect, consequential) arising from the use of or connected with our site or any products or services purchased on our site. We make no warranty or representation as to the fitness or suitability of any product or service displayed on our site. We sell services from inventory supplied by each service provider and we do not over-sell that inventory (we cannot accept liability for unavailability of services caused by a service provider over-selling its own inventory).

  5. Copyright: Images and content on our websites may not be copied, saved or used in any format other than as incidental to your permitted use of the site. 
  6. General: These terms and conditions are governed by the laws of Victoria, Australia. We receive payments from our service providers for the provision of our booking service. All references to "we", "our" and "us" are references to Escape Today Pty Ltd. For information on how we deal with your personal information please refer to our privacy policy. 
  7. By agreeing to these terms and conditions, you understand and agree that Escape Today Pty Ltd and the service provider ("Provider") and all officers, employees, agents and contractors of Escape Today Pty Ltd and the Provider have no liability in negligence, breach of contract or statute or statutory duty (including warranties implied by section 74 of the Trade Practices Act 1974 or by Part 2A of the Fair Trading Act 1999 - see below) to you for any personal injury or death arising in any way from the supply of recreational services. Recreational services include, but are not limited to, activities organised and promoted by Escape Today Pty Ltd, events and activities organised by the Provider and any other sporting activities, leisure-time pursuits, and any other activity that involves a significant degree of physical exertion or physical risk; and is undertaken for the purposes of recreation, enjoyment or leisure.

 


WARNING UNDER THE FAIR TRADING ACT 1999

For those of you that are not familiar with the Fair Trading Act 1999 (i.e. most of us!), this is a short explanation. Under the provisions of the Fair Trading Act 1999 several conditions are implied into contracts for the supply of certain goods and services. These conditions mean that the Provider is required to ensure that the recreational services it supplies to you are-

  • rendered with due care and skill; and
  • as fit for the purpose for which they are commonly bought as it is reasonable to expect in the circumstances; and
  • reasonably fit for any particular purpose or might reasonably be expected to achieve any result you have made known to the supplier.

Under section 32N of the Fair Trading Act 1999, the supplier is entitled to ask you to agree that these conditions do not apply to you. By agreeing to these terms & conditions, you will be agreeing that your right to sue the supplier under the Fair Trading Act 1999 if you are killed or injured because the services were not rendered with due care and skill or they were not reasonably fit for the purpose, are excluded, restricted or modified in the way set out in this form.

Note: The change to your rights, as set out in this form, does not apply if your death or injury is due to gross negligence on the supplier’s part. “Gross negligence” is defined in the Fair Trading (Recreational Services) Regulations 2004.
